Worrying about AWR?

Agency Workers Regulations

You will see a lot of fretting over the AWR since it has come into play on 1st October 2011.

How does it affect MAF Clients? Well the short answer is, it doesn’t.

ALL MAF clients are B2B suppliers and are exempt from AWR.

At My Accountant Friend, we are very choosey about our clients for one simple reason, to protect our current clients. We do not force a Limited Company on someone who wouldn’t benefit from our tax planning and/or shouldn’t be trading through a Limited Company, full stop!

Why are we confident everyone is exempt from AWR?

Definition taken from BIS, who is exempt;

‘Normally a professional or a person in business providing services to a client or customer is not working under that person's supervision or direction. But it is still possible for someone in a profession or in a business to be an agency worker if there is no such client or customer relationship.

Simply putting earnings through a limited company would not in itself put individuals beyond the possible scope of the Regulations.

Individuals may choose to do this for the sake of flexibility or for tax reasons.’
